Terms of use
MusiClover is a playful app for learning to read music notes, suitable for children and adults. These terms govern your use of the MusiClover app. By installing or using the app you agree to them. Please read them together with the privacy policy.
1. Who we are
MusiClover is provided by Keus.nl (Mark Keus), Industrieweg 46-8563, 6541 TW Nijmegen, the Netherlands, Chamber of Commerce (KvK) no. 94533423, under the New Angle app platform (newangle.app). In these terms “we” means Keus.nl and “you” means the user of the app. You can reach us through the contact form or by e-mail at app@keus.nl.
2. Using the app
You get a personal, non-transferable right to use MusiClover on your own device for non-commercial purposes. You may not copy, modify, sell, rent, decompile or otherwise misuse the app, and you will not use it for anything unlawful. In addition to these terms, the terms of the store where you downloaded the app (Google Play or the App Store) apply.
3. What the app is, and what it is not
MusiClover is an educational game. We do our best to teach note reading in a sound, enjoyable way, but we cannot guarantee a particular learning result; how fast someone learns depends on practice and on the person. The app does not replace a music teacher or music lessons.
MusiClover is suitable for children. If a child uses the app, a parent or guardian is responsible for supervising that use and for any purchases made in the app; the app stores will usually ask for parental approval of purchases on a child's account.
4. Your data
Everything you enter in MusiClover stays locally on your device; we have no server, no account and no copy. That also means you are responsible for your data: if you delete the app or clear its data, the data are gone and we cannot recover them. Use the app's export features or a backup of your device if you want to keep your data. How the app handles data is described in the privacy policy.
5. Purchases and payments
MusiClover is free to download, and the beginner level is always free. The app offers:
- MusiClover Plus: a one-time purchase (no subscription) that unlocks the advanced and expert levels and free practice. The price is shown in the app and in the store before you confirm.
- Voluntary contributions: small one-off amounts you can pay to support the app. A contribution is a gift of appreciation; it does not unlock any features and is not required for anything.
- Teacher codes: a teacher may give you a promo code of the store that unlocks Plus. Such a code is redeemed in the store, is subject to the store's code conditions and can be used once.
- Payment runs through the store (Google Play or the App Store), not through us. The store's own terms also apply to the purchase. We never receive your payment details.
- Refunds: refund requests go through the store and follow the store's policy. Your statutory consumer rights remain unaffected.
- Whether Plus is active is checked with the store and remembered on your device. After a reinstall or a new device, use Restore your purchase in the app. The level you reached is kept either way.
6. The app is provided as is
We build MusiClover with care, but the app is provided “as is”, without any guarantee that it is free of errors, uninterrupted or available on every device. We may change the app at any time, add or remove features, and discontinue the app or any part of it. Maintenance and improvements are delivered through updates in the store; some features may require a recent version of the app or of your operating system.
7. Liability
To the extent permitted by law, we are not liable for indirect or consequential damage, loss of data or loss of profit arising from the use of, or inability to use, MusiClover. Where liability does exist, it is limited to the amount you paid for the app in the twelve months before the event. This limitation does not apply in case of intent or deliberate recklessness on our part and does not affect your mandatory rights as a consumer.
8. Intellectual property
The app, the name MusiClover, the design, the texts, illustrations, the exercises and the software are owned by Keus.nl or our licensors and are protected by copyright and other rights. None of it may be reproduced or published without our permission. The data you enter yourself remain yours.
9. Changes to these terms
We may update these terms, for example for new features or changed legislation. The date at the top shows the latest change. We announce important changes in the app or on this page. If you keep using the app after a change, the new terms apply.
10. Applicable law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands. If you live in another country of the European Union as a consumer, you also keep the protection of the mandatory consumer rules of that country. If any provision of these terms turns out to be invalid, the remaining provisions continue to apply.
